HC upholds Section 105 of land acquisition Act

The Madras High Court on Tuesday upheld the constitutional validity of Section 105 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCT) Act of 2013. The provision was challenged because it exempts certain chapters of the legislation from being made applicable to acquisitions for national highways, railways, electricity and 10 other purposes.

A Division Bench of Justices T.S. Sivagnanam and V. Bhavani Subbaroyan held that striking down Section 105 would actually be detrimental, and not beneficial, to those whose lands were being acquired for national highways. The judges said the land owners might get deprived of benefits such as rehabilitation and resettlement provided to them. Read more

Labour safety ignored at Rampal plant

The death of 15-year-old Sajib, a worker at the Rampal Power Plant site, brought attention to an issue that went previously unnoticed — the lack of safety gears and the unsafe conditions that the plant workers have to face.

Sajib, on Friday, was electrocuted during work, as he was not wearing any protective gears. Three others were injured when they tried to save him.

They were rescued and taken to hospital by their co-workers. No authorities concerned of the plant, however, came to their aid. Read more

Coal Mining Talks On Track, Says CM

SHILLONG: Chief Minister Conrad Sangma said on Wednesday his government has brought the issue of coal ban on track in the last six months.

Talking to media persons after taking oath as the South Tura MLA, Sangma said the ban “is basically an environmental issue but later so many issues, like ownership of coal, safety of miners and the Mines and Minerals (Development and Regulation) Act came up”. Also, there was a wide communication gap between the state and the Centre, he added.
Sangma was reacting to Congress leader PT Sawkmie’s statement on Tuesday that the state government was delaying the solution to the impasse. Read more

Govt’s tribal instinct to deny rights

Adivasis have been losing forestlands, and the govt now appears to be going after activists and lawyers who fight for their rights.

After I covered the Kisan Long March earlier this year, travelling with the huge farmers’ group of mostly tribals from Nashik to Mumbai for a week, the so-called experts on my Twitter timeline presented a baffling argument: you can either be a farmer or an adivasi. I think the readers of this column know better.

Farmers have been perennially at the wrong end of land acquisition in India. Do Bigha Zameen, directed by Bimal Roy in 1953, is sadly still relevant. Adivasis are more vulnerable because most of them don’t even hold titles for the land they have tilled for decades. Under the Forest Rights Act (FRA), 2006, they are the rightful owners, but the law has hardly materialised on the ground. Read more

खदान लीजधारकों के पास 2040 करोड़ बकाया, 62 कोल ब्लॉक में 40 को खनन का लाइसेंस ही नहीं, सालाना 1120 करोड़ का नुकसान

एक तरफ राज्य सरकार उद्योगों के विस्तारीकरण और उसे बढ़ावा देने की बात कर रही है. मोमेंटम झारखंड के साथ तीन बार ग्राउंड ब्रेकिंग सेरेमनी भी हुई. सौ से अधिक एमओयू भी किये गये. लेकिन खदानों खासकर आयरन ओर और कोल ब्लॉक खुलने में अब भी पेंच फंसा हुआ है. खदाने खुलतीं तो 6000 करोड़ रुपये से अधिक की रॉयल्टी भी आती. वर्तमान में 62 कोल ब्लॉक में से 40 का लाइसेंस अब भी लंबित है.

सरकार के साथ कंपनियों की उदासीनता के कारण 79 आयरन ओर और कोल ब्लॉक में खनन का काम शुरू नहीं हो पाया. ये खदान 2006 से 2011 के बीच आबंटित किये गये थे. खदान नहीं खुलने के कारण लगभग एक लाख करोड़ की परियोजनाएं लंबित भी हैं. 40 कोल ब्लॉक शुरू नहीं होने के कारण सरकार को सालाना 1120 करोड़ का नुकसान भी हो रहा है.
